1. BeyondFrames

BeyondFrames is a platform for artists and art lovers: artist profiles and a gallery, a studio, the Studio House community and auctions of works. The platform is operated by OÜ Küberloome (registry code 14206225, address Kolde tn 6/1, Tabasalu, Harku Parish, 76901 Harju County, Estonia), the “operator”. Contact: info@beyondframes.art.

Using the platform is free.

2. Your account

  • You must be at least 13 to create an account and must give accurate details.
  • A creator account gives you the studio, the Studio House and an artist profile. Your public profile appears after the operator has reviewed it. A collector account is for bidding, following auctions and talking to artists; as a collector you can become a creator at any time.
  • Keep your password to yourself. If you suspect someone else can get into your account, change your password and log out on other devices.
  • Your account is personal. Do not let others use it and do not pretend to be someone else.
  • You can delete your account at any time in your account settings.

3. Your work and copyright

  • You keep the copyright to your works and everything else you post.
  • By uploading content you give the operator a free, non-exclusive, worldwide licence to show, store and back it up on the platform, and to use a preview of it when someone shares a page of the platform. The licence lasts as long as the content is on the platform (and in backups until they expire).
  • The operator does not use your works in advertising or sell them without your permission.
  • A finished shared canvas (Workshop) belongs jointly to the authors of its parts. Each of them may show it in their portfolio, crediting the co-authors.
  • Only upload what you made or have permission to use. Presenting another artist's work as your own is not allowed.

4. The Studio House and conduct

  • Treat others with respect. A note is about the work, not the person.
  • Harassment, threats, hate speech, spam, unsolicited advertising and illegal content are not allowed. Nudity in art is fine; pornographic content is not.
  • Do not record or share voice chats or other people's works without their permission.
  • If someone breaks these rules, report them (the “Report” button) or block them. A blocked person cannot write to you or see you among the members.
  • The operator may remove content that breaks the rules and suspend or delete the account.

5. Events

Events organised by members are the organiser's responsibility. The operator's own events are marked as BeyondFrames events. When meeting in person, take the same care as with any stranger.

6. Selling works and enquiries

  • The artist sets a work's availability and price. BeyondFrames is not the seller and does not handle money: a sale agreed through an enquiry is made directly between the buyer and the artist.
  • If the artist sells as a business (for example as a sole trader or a company), the buyer has the rights consumers have by law, including the right to withdraw from a distance contract.

7. Auction terms

  • An approved creator may auction their own work that is for sale (not sold or marked not for sale). An auction only starts once the operator approves it; the operator may also send it back for changes.
  • The artist sets the starting price, the minimum bid increment and the duration (3–14 days), and may set a hidden reserve price. The auction ends at 20:00 Estonian time on its last day.
  • Any signed-in user aged 18 or over can bid. You cannot bid on your own auction.
  • A bid must be at least the starting price, or the previous bid plus the increment.
  • Bids are binding and cannot be withdrawn: if the auction ends with your bid, you commit to buying the work at that price.
  • If a bid is placed in the last 5 minutes, the auction is extended by 5 minutes.
  • If the hidden reserve price is not met, the work is not sold and neither side owes the other anything.
  • The artist can cancel the auction before the first bid. The operator may cancel an auction that breaks these terms.
  • When the auction ends, the winner and the artist see each other's name and email. The sale is made directly between them: they agree payment, shipping or handover and its costs between themselves. The artist is responsible for the work matching its description and image.
  • BeyondFrames does not handle money, is neither the seller nor the buyer, and is not responsible for the condition of the work, payment or delivery.
  • If the winner does not pay or the artist does not sell, tell the operator. The operator may restrict a user who ignores their obligations from auctions or close their account.
  • Amounts are in euros.

8. Liability

We keep the platform running and the data backed up, but cannot promise it will always work without interruptions or faults. The operator is not responsible for users' content or for agreements and transactions between users. The operator's liability is limited to the extent permitted by law; the limit does not apply to intent or gross negligence.

9. Suspension and closing an account

You can delete your account yourself at any time. The operator may suspend or delete an account that breaks these terms, and where possible will tell you in advance and explain why.

10. Changes

These terms may change. We will announce material changes on the platform at least 14 days in advance. If you keep using the platform after that, the new terms apply; if you do not agree, you can delete your account.

11. Governing law and disputes

These terms are governed by Estonian law. We try to resolve disputes by negotiation. Consumers may also turn to the Consumer Disputes Committee (www.ttja.ee). If no agreement is reached, disputes are settled in Harju County Court unless the law provides otherwise.
